Your Rights Under USERRA

Short Tour of Duty

Upon request, any employee shall be granted a military leave of absence to engage in a temporary tour of duty with the National Guard or any recognized branch of the military service not to exceed fifteen (15) days in any calendar year.

The University will pay the difference between the employee’s military pay and regular pay, if military pay is less.

For many of the employee groups, if the employee requests and is scheduled for vacation during the military leave, the employee will receive full vacation pay rather than the difference in pay as described above.

Employee Responsibilities:

  • Notify your supervisor well in advance of your actual tour of duty.
  • Forward a copy of your military orders to your supervisor.

Supervisor Responsibilities:

  • Request and complete an Unpaid Leave of Absence form from HR/Employment Services at Rowe 109 for staff; or Faculty Personnel Services at Warriner 308 for faculty.

Long-Term or Extended Military Service

The University will comply with state and federal laws regarding leaves and/or reinstatement rights for employees who volunteer for military service.

Initially, employees will be placed on an unpaid leave of absence with employer health contributions. After thirty (30) days on leave, employees will be placed on unpaid leave without employer health contributions. The employee will be responsible for full benefit premiums.
