Performance Licensing

Information about and specific licenses pertaining to broadcasting and/or webcasting at Central Michigan University.

Terms used

  • Webcasting - To place a recorded or "live" performance on the Internet; either the artist's or University's
  • Broadcasting - To broadcast an artist's original "live" or recorded performance (e.g., Garth Brook CD).
  • Performance - Non-dramatic performances of copyrighted compositions by faculty, staff and students.

General information

The Broadcasting and Webcasting license for Radio and TV is separate from the ASCAP and SESAC license and is currently covered under BMI.

All 3 vendors indicated that all internet licensing must remain separate from any other Performance/Broadcasting Agreement CMU may have for PBS or WMHW.

  • WMHW - (FM Radio, Moore Hall TV)
  • PBS - (Public Broadcasting) (Radio and TV)

Dramatic events

All Dramatic Events must be covered under one of the following:

  • MTI: Musical Theatre International
  • R&H: Rogers & Hammerstein
  • Samuel French

Example: When a play is put on by the drama department, the professor must contact one of the above and obtain permissions, determine royalty obligations, if any, and pay royalty obligations.

Recording an artist's work

  • Requires special permission (Master License)
  • You will need information such as, Artist, Song Title, Publisher, Writer, Label, Release Date. To search, use http://www.songfile.com/.
  • Directly contact the Recording Company for permissions (e.g., Sony, MCA, Interscope)

Covered

  • Non-Dramatic Public Events & Performances | e.g. Faculty/Staff/Student performances, a booked act (e.g., Garth Brooks); music played at a public event (e.g., records, CDs, tapes); concerts, parties, live entertainment.

Non-covered

  • Dramatic Events | e.g. Musicals, plays, operas, ballet performances, and music used as part of a play. You'll need a "grand rights" license.
  • Co-presentations and co-sponsors.

Current license information

  • July 1 - June 30th each year auto-renewing contract through NACUBO.

Invoicing information

  • December 2023, Last Invoice Paid: $6,423.60.
  • Payments are issued from 24606-7507, Academic Administration department.
  • Performance-General Campus License and Webcast are invoiced together.

ASCAP - Webcast

  • Base URL coverage: www.cmich.edu
  • Performance/Broadcasting/Webcasting for Central Michigan University Website: Publicly perform, by means of Web Site Transmissions, non-dramatic renditions of the separate musical compositions in our Repertory.

Current license information

  • Effective January 1, 2002, auto-renewing contract
  • Fee schedule is submitted by CMU Purchasing Services annually and is due in April of each year. These forms are mailed directly from ASCAP in February each year.
  • Annual Invoicing is based on the greater of licensing of Revenue or Site Traffic - (hits).

BMI - Webcast and Broadcast

  • Webcast & Broadcast - WMHW & PBS are fully covered to broadcast through an NPR (National Public Radio) agreement, all performances over the internet. However, BMI is negotiating with NACUBO to create an internet-only license that will need to be purchased independently of the current NPR agreement.

  • July 1 - June 30th each year auto-renewing contract through NACUBO.
  • Annual Invoicing is based on the number of students at the university.

  • Base URL coverage: www.cmich.edu
  • Performance/Broadcasting / Webcasting; Publicly perform the copyrighted compositions of our affiliated songwriters and music publishers on the website described in the license agreement. Quote: "the non-exclusive right and license to publicly perform non-dramatic renditions of the musical compositions, by transmission on or through the Licensee's entity."

Current license information

  • Effective April 1, 1999, auto-renewing contract.
  • Semi-annual billing is based on Website Traffic Hits; last payment issued was based on 100,000 average monthly hits to CMU's website.
  • License renewal is submitted by CMU Purchasing Services annually. Fee schedule submitted via the web to report average monthly hits.
